CiA’s European Union (EU) trademark policy

Preamble

Objective of this policy is to outline the usage of the European Union (EU) trademarks owned by CAN IN AUTOMATION international users' and manufacturers' group e. V. (in the following CiA e. V.). EU trademarks in the following are the EU trademark 00 710 98 46 “CiA”, EU trademark 00 709 22 73 “CANopen”, EU trademark 01 358 68 39 “CANopenFD”, and EU trademark 01 873 80 53 “CANsec”.

The authorization to use extends to the entire mark with the registrations in classes 7; 9; 16; 41; 42.

§ 1

CiA e. V. entitles the following parties to use the following EU trademarks in all their written or electronic publications and promotional material:

  1. “CANopen”, CANopenFD”, and “CANsec”: Members of CiA e. V. and their distributors and other sales partners (including resellers) for their devices, software, tools, and services such as seminars and system integration;
  2. “CANopen”, CANopenFD”, and “CANsec”: Non-commercial and academic institutes and associations for their non-profit products and services, if they have been registered by CiA e. V.;
  3. “CANopen” and CANopenFD: Owners of CANopen vendor-IDs assigned by CiA e. V. their distributors, and other sales partners (including resellers) for their devices, tools, and services such as seminars and system integration;
  4. “CANopen” and CANopenFD”: Non-members of CiA e. V. and their distributors and other sales partners (including resellers) for their software, tools, and services such as seminars and system integration, if they have been registered by CiA e. V..
§ 2

The right to use the EU trademarks as permitted in § 1 is non-exclusive and non-transferable.

§ 3

It is not permitted to register company names, web domains, or own trademarks, which contain CiA’s EU trademarks.

Company names and own trademarks registered before the EU trademarks have been registered may still be used.

Web domains containing CiA’s EU trademarks shall be handed over to CiA e. V.

§ 4

It is not permitted to use the EU trademarks:

  1. For devices, software, tools, and services, which are not based on CiA e. V. technical documents or international standards by ISO, IEC, CEN, or CENELEC deriving from CiA e. V. technical documents;
  2. In a way, which inflicts damage on CiA e. V. or its members (e.g. negative promotion).
§ 5

The users of CiA’s EU trademarks shall reference the EU trademarks owner. The users respect these EU trademarks as the intellectual property of CiA e. V. and do not object to them.

§ 6

CiA e. V. does not warrant the legal validity of the EU trademarks and does not accept any liability that the EU trademarks may be used without infringing any rights of third parties.

§ 7

In case of misusage of the EU trademarks, CiA e. V. reserves the right to request the user to stop the misusage within 30 days. In case of nonobservance, CiA e. V. may terminate the right to use the EU trademarks.

Annex

The EU trademark “CAN XL” originally registered for CiA e. V. has been transferred to Robert Bosch GmbH. According to a contract between CiA e. V. and Robert Bosch GmbH, members of CiA e. V. have the right to use the term “CAN XL”.
